PUTRAJAYA: The Election Commission has succeeded in its bid to get a stay against a High Court ruling calling for a by-election for the Kota Siputeh state seat in Kedah.
The Court of Appeal has ruled that there were special circumstances to grant a stay to the commission.
A three-men bench of the Court of Appeal ruled that no party will suffer prejudice if the stay was granted to the commission.
Earlier in the morning Datuk Abu Hassan Sarif filed an application to stay the Nov 16 landmark ruling that he was no longer Kota Siputeh assemblyman, that his state seat was vacant and that a by-election must be held.
He filed the document and a certificate of urgency at the Court of Appeal registry through his lawyer Abu Bakar Isa Ramat.
Abu Hassan personally affirmed the affidavits at the Commissioner of Oaths counter in Putrajaya at 10am for this.
A similar stay application by Election Commission was heard at the Court of Appeal at 2.30pm Tuesday.
